Community Infrastructure Levies archive

Community Infrastructure Levy (CIL) is a charge on development which local planning authorities may introduce in their areas to help fund the social, environmental and physical infrastructure that the new development will need.

Two separate CIL charges will apply in the Legacy Corporation; the Mayor of London’s Community Infrastructure Levy (Mayoral CIL) which is intended to raise £300 million towards the delivery of Crossrail, and the Legacy Corporation’s CIL which is expected to come into effect in early 2015 and which is intended to fund infrastructure which will support the regeneration of the Legacy Corporation’s Area.  

Mayoral CIL came into effect on 1 April 2012 and your development may currently be liable for Mayoral CIL charges.  For more detailed information on the London Mayoral CIL, please visit Transport for London’s CIL webpage.

If your development is liable for Mayoral CIL, you will need to complete a CIL Additional Information form with your application before we can process it.  More information can be found on the Planning Portal.

Previous Stage: Approval and publication of charging schedule

In accordance with Regulation 25 of the Community Infrastructure Levy Regulations 2010 (as amended) the London Legacy Development Corporation (LLDC) Community Infrastructure Levy Charging Schedule was approved at a meeting of its Board on the 29 January 2015.

Instalment Policy

As set out in the Charging Schedule, the Legacy Corporation follows the Mayor of London’s Instalment Policy. 

Examination

The Charging Schedule was subject to independent examination.

The examiner recommended one modification to meet the statutory requirements, which was to substitute new maps in the Charging Schedule that meet the requirements of the Regulations. The specified modification does not alter the basis of the Legacy Corporation’s overall approach or the appropriate balance achieved.

Previous Stage: Publication of the Examiner’s Recommendations and Reasons

In accordance with Regulation 23 of the Community Infrastructure Levy Regulations 2010 (as amended) the London Legacy Development Corporation received the recommendations and reasons from the examiner on the 27 November 2014

The examiner’s report concludes that the London Legacy Development Corporation Community Infrastructure Levy Charging Schedule provides an appropriate basis for the collection of the levy in the area. The Legacy Corporation has sufficient evidence to support the schedule and can show that the levy is set at a level that will not put the overall development of the area at risk. 
 
The examiner has recommended one modification to meet the statutory requirements. This can be summarised as follows:

  • Substitute new maps in the Charging Schedule that meet the requirements of the Regulations.  

The specified modification recommended in this report does not alter the basis of the Legacy Corporation’s overall approach or the appropriate balance achieved. 
 
The Charging Schedule now needs to be approved by the Legacy Corporation Board before it comes into effect. The next Board meeting is currently scheduled for sometime in January 2015

Previous Stage: CIL Examination

In accordance with Regulation 19 of the Community Infrastructure Levy Regulations 2010 (as amended), the London Legacy Development Corporation submitted the London Legacy Development Corporation community infrastructure levy draft charging schedule (DCS) and associated information and documents to the Planning Inspectorate on 6 August 2014.

An independent examiner has been appointed. The examiner, Mike Moore, is responsible for carrying out the examination and any public hearings. A public hearing was due to be held on the 22nd October at the Legacy Corporation’s offices.  However, all those parties who had earlier indicated that they would wish to be heard at the hearing have indicated that they no longer want to speak. On that basis the Examiner has decided that the hearing should be cancelled.

He will therefore conclude his examination based on the written representations submitted to date and any further statements that have been submitted in response to his main issues and in accordance with the timetable set out in the Briefing Note issued to all parties on 1st September 2014.

Previous Stage: Draft Charging Schedule Consultation

On 30 April 2014 the Legacy Corporation Board agreed that the CIL Draft Charging Schedule, associated documents (Draft Infrastructure List, Draft Planning Obligations SPD) and evidence (Infrastructure Delivery Plan and Viability Study) be published for consultation.  

The Legacy Corporation sought comments from any interested individuals or organisations. The consultation period ran for a six week period, from 27 May 2014 to 8 July 2014, representations had to be received during this period and before 5pm on 8 July.
